Terms & Conditions of Sale

1. Introduction

1.1 These Terms & Conditions (“T&Cs”) apply to the purchase of the (“Product”) offered by Career Cliniq ABN: 37 822 681 611, of Dixson Ave, Dulwich Hill , NSW, Australia).

1.2 By placing an order via our checkout cart, you (“you”, “Customer”) agree to be bound by these T&Cs. If you do not agree, do not purchase the Product.

2. Product Description and Access

2.1 The Product is described on our website for health professionals.
2.2 On successful payment, you will receive instant access (via email or dashboard depending on our system) to the Product.
2.3 You acknowledge that the Product is delivered digitally (not physical goods).
2.4 We reserve the right to modify the format, presentation or features of the Product at our discretion, provided the core functionality remains as described.

3. Pricing & Payment

3.1 The price of the Product is as displayed on the website at the time you place your order.
3.2 Payment must be completed at checkout by the methods listed on the website.
3.3 All prices are in AUD (unless otherwise stated) and include GST if applicable.
3.4 We reserve the right to change pricing at any time, but changes will not affect orders already placed and accepted under these T&Cs.

4. Refunds & Guarantee

4.1 To be eligible for a refund you must contact us at [email protected] within [insert number, e.g., 14] days of purchase, explaining your issue.
4.2 We reserve the right to assess the request and approve or reject it at our discretion.
4.3 If approved, we will process the refund to the original payment method within a reasonable time.
4.4 If you download, print or use the Product in full and claim a refund, we may require confirmation you will not continue to use the Product.
4.5 Since the Product is delivered digitally, by purchasing you acknowledge that you lose the right to “cooling-off” refund for physical goods in some circumstances, but we still provide the above guarantee.

5. Delivery & Access

5.1 Delivery of access to the Product is immediate or near-immediate upon successful payment, unless technical or other issues outside our control intervene.
5.2 We are not responsible for delays caused by your internet connection, device, or other user-side factors.
5.3 If you fail to receive access, please contact [email protected] and we will endeavour to resolve the issue promptly.

6. Licence & Use

6.1 On purchase, you are granted a non-exclusive, non-transferable licence to access and use the Product for your own personal, professional development.
6.2 You may not resell, sublicense, modify, reproduce, distribute, share or otherwise exploit the Product (or parts thereof) for commercial purposes.
6.3 You agree to use the Product in compliance with all applicable laws and not to use it for illegal or unethical purposes.

7. Intellectual Property

7.1 All intellectual property rights (including copyright, trade-marks, design rights, database rights) in the Product, the website, and all materials provided remain with Career Cliniq (or its licensors).
7.2 Nothing in these T&Cs transfers ownership of any intellectual property to you.

8. Limitation of Liability & Disclaimer

8.1 To the maximum extent permitted by law, Career Cliniq excludes all liability for any indirect, incidental, special or consequential losses or damage (including loss of income, profits, business opportunity or data) arising out of or in connection with your use of the Product.
8.2 Our total aggregate liability for any claim arising from or in connection with the Product shall not exceed the amount you paid for the Product.
8.3 The Product is intended to provide guidance and clarity about career options. It is not a guarantee of any specific job, income, outcome or result.
8.4 We make no warranties (express or implied) other than those set out in these T&Cs. For example, we do not warrant that the Product will be error-free, perfectly suitable for your particular situation, or available uninterrupted.

9. Consumer Guarantees

9.1 If you are a consumer under the Australian Consumer Law (ACL), certain guarantees apply, including that the Product will be of acceptable quality and fit for purpose.

9.2 To the extent permitted by the ACL, our liability for breach of a guarantee is limited, at our option, to: (a) supplying the Product again; or (b) refunding the fees paid.
9.3 This does not affect rights you have under the ACL that cannot be excluded.

10. Privacy

10.2 By purchasing the Product, you acknowledge you have read and accept the Privacy Policy.
10.3 You consent to us collecting, using and storing your personal data to provide the Product and related services (including access via email, support communications).

11. Termination

11.1 We may terminate or suspend your access to the Product (including for failure to pay, suspected breach of licence or misuse) immediately, without liability.
11.2 On termination, you must cease use of the Product, destroy or delete any copies and confirm to us if requested.

12. Governing Law & Jurisdiction

12.1 These T&Cs are governed by the laws of New South Wales, Australia.
12.2 You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.

13. General

13.1 These T&Cs constitute the entire agreement between you and Career Cliniq in respect of the Product and supersede all prior agreements, understandings or representations.
13.2 If any provision of these T&Cs is held invalid or unenforceable, that provision shall be severed and the remainder shall continue in full force and effect.
13.3 We may amend these T&Cs from time to time. Changes will apply to future purchases only and will be posted on our website.
